This MPN Tracker Tool (the "Tracker Tool") is provided by Incyte Corporation ("Incyte").
By clicking "I AGREE" below, you agree to and accept the following terms governing your registration and use of the Tracker Tool. By clicking "I AGREE" below, you also affirm your understanding and agreement to the terms set forth in the Legal Notices on the Voices of MPN website, which are incorporated into this agreement by reference.
By clicking "I AGREE" below, you acknowledge your understanding that the personal information you provide to register for an account for use of the Tracker Tool ("Registration Information") may be used by Incyte, or other companies acting on its behalf, to contact you via mail, via telephone, in electronic format, via Internet-based delivery or otherwise in the future. You authorize Incyte and its agents to use the Registration Information to contact you via mail, telephone, Internet-based or electronically (e.g., Internet) or otherwise in the future and use and release information about you only for the purposes of (i) providing education and ongoing support services to you related to treatment, disease, and other areas of interest; and (ii) gathering feedback on your therapy treatment and/or disease state. You understand that some of your Registration Information may be provided anonymously and used in an individual or aggregated form for other legitimate purposes by Incyte. Neither Incyte Corporation nor anyone working on behalf of Incyte will sell or rent your Registration Information. You understand that reasonable efforts will be made to keep your Registration Information private even though information disclosed under this User Agreement may not be protected under federal and state privacy laws. Your Registration Information may also be used for the purposes described in the Privacy Policy. You understand that from time to time, Incyte's Privacy Policy may change and that you should check the website for the most recent version. You understand that you should check the website for the most recent version of Incyte’s Legal Notices.
THE TRACKER TOOL DOES NOT PROVIDE MEDICAL ADVICE. IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL YOUR DOCTOR OR 911 IMMEDIATELY. Your use of the Tracker Tool and any information produced by the Tracker Tool is at your own risk. The Tracker Tool and the information produced by the Tracker Tool is intended for informational and educational use only. The Tracker Tool and the website on which it is located do not provide medical advice, do not provide a diagnosis or other recommendation for treatment and are not a substitute for the professional judgment of a Healthcare Professional in the diagnosis and treatment of any person. The determination of the need for medical services and the types of health care to be provided to a patient are decisions that should be made only by a physician or other licensed healthcare provider. Always seek the advice of a physician or other qualified healthcare provider with any questions you have regarding a medical condition. Incyte accepts no responsibility for your reliance on information resulting from use of the Tracker Tool. You alone are responsible for the quality and accuracy of any data that you input into the Tracker Tool. You assume all risks associated with your data, including anyone’s reliance on its quality, accuracy, or reliability, or any disclosure by you of information in your data that makes you personally identifiable.
You should refrain from exporting data using the "Download or Share Your Results" feature of the Tracker Tool unless you are certain that the receiving email address or designated storage location is authorized, credible, and secure. By clicking "I AGREE" below, you acknowledge that anyone can access and view the data you entered into the Tracker Tool if your smartphone, tablet, computer, or other device on which you access the Tracker Tool is outside of your immediate control. You recognize and agree to fulfill your responsibility to protect the privacy of your data by keeping your device secure at all times and using all means possible to secure the data you input into the Tracker Tool, including not sharing the username and password you generate when you register your account using Registration Information.
All of the data you enter, including your account information, symptom scores, and blood count targets, are saved in a secure database. Please note that the information you enter into the Tracker Tool is not shared unless you choose to email that information to a third party, such as your Healthcare Professional. If you decide you do not want to receive communications about your Tracker Tool, you may opt out at any time by updating your account information.
You agree that Incyte may collect and collate a variety of information regarding the use of the Tracker Tool and may cause the Tracker Tool to communicate information about its operations to Incyte even if you are not connected to the Internet. Collection and management of this information is governed by Incyte’s Privacy Policy which is made part of this agreement. If you do not want Incyte to use data as described in its Privacy Policy, please do not use the Tracker Tool.
We reserve the right to cease operation of or modify the Tracker Tool and any function, service or material we provide on or through the Tracker Tool in our sole discretion and without notice. We will not be liable if for any reason all or any part of the Tracker Tool is unavailable at any time or for any period.
IN NO EVENT WILL INCYTE, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, MANAGERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE TRACKER TOOL OR ANY CONTENT ON THE TRACKER TOOL, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.
You agree to defend, indemnify and hold harmless Incyte, its affiliates, licensors, and service providers, and its and their respective officers, directors, managers, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of this User Agreement or your use of the Tracker Tool, including, but not limited to, any use of the Tracker Tool’s content, services, and products other than as expressly authorized in this User Agreement or your use of any information obtained from the Tracker Tool.
